1. Acceptance of Terms
By accessing or using the Moksha EduSystems platform ("Platform"), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and Moksha EduSystems. If you do not agree to these Terms, you must immediately discontinue your use of the Platform.
2. Platform Services and User Roles
Moksha EduSystems provides a digital school management system to educational institutions. The contracting school ("School") acts as the primary administrator of the data. User access is strictly role-based:
- Students: Access to authorized academic records, assignments, attendance, and exam results.
- Parents/Guardians: Access to fee payment portals, student progress tracking, and report cards.
- Teachers: Tools to create lesson plans, record daily attendance, and manage exam grading.
- Administrators: Capabilities to configure school-wide settings, manage user access, oversee financial records, and ensure systemic compliance.
3. Account Responsibilities and Security
- Accuracy: Users must provide accurate, current, and complete information during registration and maintain the accuracy of this information.
- Security: Users are solely responsible for maintaining the confidentiality of their login credentials.
- Unauthorized Access: Any unauthorized use of an account or breach of security must be reported immediately to the School administration. Moksha EduSystems is not liable for any loss or damage arising from your failure to protect your login credentials.
4. Fees, Payments, and Third-Party Gateways
- Payment Processing: All fee payments facilitated through the Platform are processed securely and exclusively through Paytm.
- Liability: Moksha EduSystems acts solely as a technological bridge for these transactions. We are not responsible for transaction failures, gateway downtime, or processing errors originating from Paytm.
- Refunds: All financial disputes, including refund requests, chargebacks, or fee adjustments, must be directed to and resolved by the School administration in accordance with the School's internal policies. Moksha EduSystems does not process or issue refunds directly to end-users.
5. Academic Records and CBSE Compliance
While Moksha EduSystems provides the framework to generate report cards, attendance records, and exam results in compliance with CBSE guidelines, the School and its authorized Teachers are solely responsible for the accuracy, legality, and integrity of the data entered into the system. Any requests for data correction must be routed directly through the School.
6. Acceptable Use Policy
Users agree to use the Platform only for lawful educational and administrative purposes. Users shall not:
- Misuse the platform for any fraudulent, malicious, or illegal activities.
- Attempt to bypass, disable, or tamper with role-based access controls or security features.
- Upload, transmit, or distribute any harmful software, viruses, or malicious code.
- Reverse engineer, decompile, or disassemble any part of the Platform.
7. Intellectual Property Rights
- Platform Ownership: All source code, designs, branding, algorithms, and software architecture belonging to Moksha EduSystems are our exclusive intellectual property. Users are granted a limited, non-exclusive, non-transferable license to use the Platform.
- User Data: The School and its end-users retain all ownership rights to the personal data, academic records, and files uploaded to the Platform.
8. Service Availability and Maintenance
We strive to ensure maximum uptime for Moksha EduSystems. However, the Platform is provided on an "as is" and "as available" basis. We reserve the right to perform scheduled maintenance, updates, or technical improvements, which may result in temporary service interruptions. We will make reasonable efforts to notify School administrators in advance of any significant scheduled downtime.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Moksha EduSystems, its developers, and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or use, incurred by you or any third party, arising from:
- Your access to or use of the Platform.
- Any conduct or content of any third party on the Platform.
- Unauthorized access, use, or alteration of your data.
10. Termination of Access
Moksha EduSystems, in coordination with the School administration, reserves the right to suspend or terminate user accounts that violate these Terms, engage in disruptive behavior, or compromise the security of the Platform. Upon termination, your right to use the platform will immediately cease.
11. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of India. Any legal disputes, claims, or proceedings arising out of or relating to these Terms or the use of the Platform shall be subject to the exclusive jurisdiction of the competent courts located in Nandyala, Andhra Pradesh.
