This Privacy Policy explains how we collect, use, and safeguard information in compliance with CBSE guidelines and the Digital Personal Data Protection (DPDP) Act, 2023 of India, as well as other applicable data protection laws.
2. Information We Collect
- Student Data: Name, date of birth, academic records, attendance, and health information (if provided). Note: Academic records are managed in accordance with CBSE standards.
- Parent/Guardian Data: Name, contact details, and fee payment records.
- Teacher Data: Professional details, lesson plans, and exam records.
- System Usage Data: Login credentials, role-based activity logs, and device/browser information.
- Payment Data: Transaction details processed exclusively through Paytm.
3. Purpose of Data Use
- To manage academic records, attendance, and exam results.
- To generate CBSE-compliant report cards with percentile and grade calculations.
- To facilitate secure fee payments and maintain transaction history.
- To provide role-based dashboards for Teachers, Students, and Parents.
- To ensure compliance with educational, financial, and data protection regulations.
4. Children's Privacy and Verifiable Parental Consent
In strict accordance with the DPDP Act, 2023, Moksha EduSystems recognizes that anyone under the age of 18 is considered a child. We apply heightened safeguards for the processing of children's data:
- Parental Consent: We do not process student data without verifiable parental consent. Moksha EduSystems relies on the contracting educational institution (the school) to secure this verifiable consent from parents or legal guardians before creating student profiles or utilizing student data on our platform.
- No Tracking: We strictly prohibit the behavioral monitoring, tracking, or targeted advertising directed at children using our platform.
5. Cookies and Session Management
Our platform utilizes strictly necessary cookies and similar technologies (such as JSON Web Tokens or local storage) exclusively to maintain secure, role-based login sessions, authenticate users, and ensure core platform functionality. We do not use cookies for targeted advertising or third-party behavioral tracking.
6. Data Sharing and Data Residency
We do not sell personal data. All student, parent, and teacher data is securely hosted on PostgreSQL databases located strictly within servers residing in India, ensuring compliance with local data localization preferences.
Information may be shared only with:
- Payment Gateway: Paytm (processed exclusively for fee transactions).
- Regulatory Authorities: When required by law (e.g., CBSE compliance or lawful government requests).
- Service Providers: Assisting in hosting and security. These providers are bound by strict confidentiality agreements and cannot use your data for their independent purposes.
7. Data Security and Incident Response
We implement industry-standard security measures, including:
- Role-based access control (Teacher, Student, Parent, Admin).
- Encryption of sensitive data (student records, payment details) in transit and at rest.
- Secure hosting on Supabase/PostgreSQL with comprehensive audit logs.
In the highly unlikely event of a data breach that compromises personal information, Moksha EduSystems will notify the affected school administrators, users, and the Data Protection Board of India (DPBI) without undue delay, as required by law.
8. User Rights
Under the DPDP Act, users possess the following rights:
- Students/Parents: Access academic records, request corrections to inaccurate data, and manage fee payments.
- Teachers: Manage lesson plans, exam records, and student performance data.
- Parents: View and download fee receipts, report cards, and transaction history.
- All Users: The right to request the erasure of personal data, subject to regulatory retention requirements and school approval.
9. Data Retention
- Academic records are retained as per CBSE guidelines.
- Payment records are retained for statutory financial compliance.
- User accounts and associated personal data are deleted upon request or when no longer necessary for the purpose they were collected, subject to school approval.
10. Third-Party Services
Our platform integrates only with Paytm for payments. We are not responsible for Paytm’s independent privacy practices. We encourage users to review Paytm's privacy policy for transaction-related details.
11. Grievance Redressal
In compliance with the DPDP Act, 2023, Moksha EduSystems has appointed a Grievance Officer to address any concerns regarding the processing of personal data. We are committed to acknowledging and resolving grievances within the timelines mandated by law (currently within 7 days of receipt).
